Page 1 — Acceptance of Terms
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services. Additional terms may apply to specific features (e.g., promotions, gift cards, seller tools); where conflicts arise, those specific terms prevail to the extent of the conflict.
- These Terms form a binding agreement between you and Satviksh.
- Headings are for convenience only and do not affect interpretation.
- Where local law requires different terms, those requirements prevail.
Page 2 — Eligibility & Account
You must be legally capable of forming a binding contract and comply with all applicable import/export and sanctions regulations. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
- Provide accurate, current, and complete registration information.
- Notify us immediately of any unauthorized access or suspected breach.
- We may refuse service, close accounts, or cancel orders at our discretion where permitted by law.
Page 3 — Service Description (Marketplace & Custom Sourcing)
Satviksh operates an international e‑commerce marketplace and a custom‑sourcing service for region‑specific items (e.g., local Indian pickles on request). Product listings may be provided by us or third‑party sellers. Images and descriptions are for reference; actual packaging, origin, or specifications may vary within lawful tolerances.
- Availability, lead times, and shipping options vary by destination and product type.
- Perishable, fragile, or made‑to‑order items may carry special handling requirements.
- We reserve the right to limit quantities and to refuse requests that violate law or policy.
Page 4 — Orders & Contract Formation
Your order is an offer to buy. We accept only when we dispatch the product(s) or otherwise confirm acceptance. Automated confirmations acknowledge receipt but are not acceptance. We may cancel all or part of an order (with a refund where applicable) for reasons including pricing or availability errors, export restrictions, suspected fraud, or force majeure.
- Custom orders require clear instructions and may be non‑cancelable once sourcing begins.
- We may request identity or address verification prior to dispatch.
Page 5 — Pricing, Currency, Taxes & Duties
Prices are displayed in the currency indicated at checkout and may exclude or include taxes and duties as specified. You are responsible for any additional import duties, taxes, brokerage, or clearance fees unless we expressly state otherwise at checkout.
- We strive for accuracy but pricing or typographical errors may occur; we may cancel and refund affected orders.
- Promotions and coupons are subject to terms and may not be combined unless stated.
Page 6 — Shipping, Delivery & Risk of Loss
Shipping timelines are estimates only and are not guaranteed. Risk of loss and title for products pass to you upon our delivery to the carrier (FOB shipping point), unless mandatory law in your jurisdiction requires otherwise. Delivery may be delayed by customs inspections, regulatory controls, weather, or carrier issues.
- Tracking numbers and carrier updates are provided when available.
- Signature on delivery may be required for high‑value shipments.
- Undeliverable or refused shipments may incur return and reship fees.
Page 7 — Inspection, Returns & Refunds
Strict Policy: To maintain product integrity (especially for perishables, consumables, and customized items), we generally do not accept returns, exchanges, or refunds once an order is dispatched, to the maximum extent permitted by applicable law. This includes dissatisfaction due to taste, fragrance, or regional variation for artisanal goods.
If your parcel arrives visibly damaged, tampered, or short, you must note this with the carrier at delivery and notify us promptly with photos and an unboxing video. Carrier loss or damage claims must be filed with the carrier; we will provide reasonable assistance but Satviksh and our delivery partners are not responsible for loss or damage after hand‑off to the carrier, except where non‑disclaimable by law.
- Custom‑sourced or made‑to‑order goods are final sale.
- For any return accepted under mandatory law, items must be unused, sealed, and in original packaging with all inserts.
- Refunds, where approved, are processed to the original payment method minus shipping/handling, duties, and non‑recoverable fees.
Nothing in these Terms affects your statutory rights that cannot be limited under applicable law.
Page 8 — International Trade, Customs & Compliance
You authorize us and our logistics partners to act as your agent with customs and other authorities to clear and deliver your shipment. You are responsible for ensuring the products are lawful to import at your destination. We may decline to ship prohibited, restricted, or temperature‑sensitive items where safe transit cannot be ensured.
- We comply with export controls and sanctions; we may cancel orders to restricted parties or destinations.
- Delays due to inspections or regulatory holds are outside our control.
Page 9 — User Conduct & Acceptable Use
You agree not to misuse the Services. Prohibited activities include fraud, reshipping schemes, IP infringement, circumvention of geo‑blocks, reverse engineering, harmful code, scraping without permission, or activities that harm reputation or operations.
- We may monitor for abuse and enforce technical or legal measures.
- Violations may result in suspension or termination without notice.
Page 10 — Intellectual Property & Licenses
All content on the Services (text, graphics, logos, images, software) is owned by Satviksh or its licensors and is protected by applicable laws. Subject to your compliance, we grant you a limited, non‑exclusive, non‑transferable license to access and use the Services for personal, non‑commercial purposes.
- Do not copy, modify, distribute, or create derivative works without permission.
- Trademarks and brand features may not be used without written consent.
Page 11 — Third‑Party Services & Links
The Services may contain links to or integrate third‑party services (e.g., payment gateways, shipping carriers). We are not responsible for their content, terms, or policies. Your use of such services is at your own risk and subject to their terms.
Page 12 — Warranties, Disclaimers & Availability
The Services and products are provided on an "as is" and "as available" basis to the fullest extent permitted by law. Without limiting the foregoing, we disclaim all warranties of merchantability, fitness for a particular purpose, and non‑infringement, and do not warrant uninterrupted, error‑free, or secure operation.
Page 13 — Limitation of Liability
To the maximum extent permitted by law, Satviksh and its delivery partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss, theft, damage, spoilage, delay, or missed delivery after hand‑off to the carrier. Our total liability for any claim relating to the Services or products shall not exceed the amount you paid for the order giving rise to the claim.
Certain jurisdictions do not allow limitations on implied warranties or exclusion/limitation of certain damages; where such laws apply, some limitations in this section may not apply to you.
Page 14 — Indemnification
You agree to defend, indemnify, and hold harmless Satviksh, its affiliates, officers, employees, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your use of the Services, violation of these Terms, or violation of any law or rights of a third party.
Page 15 — Suspension, Termination & Remedies
We may suspend or terminate your access, cancel orders, or restrict features immediately if we believe you have violated these Terms, engaged in unlawful conduct, or created risk or possible legal exposure. We may pursue any remedy available at law or in equity.
Page 16 — Governing Law & Dispute Resolution
These Terms and any dispute arising out of or relating to them shall be governed by the laws of the jurisdiction where Satviksh is established, without regard to conflict‑of‑laws rules. You agree to the exclusive jurisdiction and venue of the courts located in that jurisdiction, unless mandatory consumer protection law provides otherwise. Before filing suit, the parties will attempt to resolve disputes through good‑faith negotiations.
Page 17 — Changes to the Services or Terms
We may modify the Services or these Terms at any time. Updates will be effective when posted, unless a later date is stated. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
